1. Platform Role & Marketplace Status

Jogeave is a Marketplace Facilitator. We operate strictly as a technology marketplace. We do not employ, contract, represent, or assign any users. All engagements are directly between independent parties (Hirers and Workers). Our role is limited to facilitating secure payments, providing escrow integrations, logistics integrations, and communication tooling.

2. Worker Classification

Workers on the Jogeave platform are classified as Independent Contractors (1099 status in the US), not employees.

  • Control: Workers rely on their own judgment and skill to complete projects. They set their own rates, choose which projects to accept, and control their own work methods.
  • Core Business: The services provided by Workers are not the core business of the Platform; we provide the connection and tools, not the creative or technical execution.
  • Independent Business: Workers are customarily engaged in an independently established trade, occupation, or business.

3. Payments & Escrow Services

Jogeave never holds user funds. All monetary transactions are processed through licensed third-party escrow and payment partners (including Stripe Connect, Escrow.com, Adyen, and Wise).

  • Funds flow directly from the Hirer to the licensed partner and then to the Worker upon project completion or milestone release.
  • We facilitate the release of funds via API triggers but do not take custody of funds at any point.
  • Users are responsible for setting up and verifying their Connected Accounts (e.g., Stripe Connect) to receive payouts.

4. Travel & Logistics Disclaimer

Jogeave acts as an orchestrator, not a travel agency of record. Hirers acknowledge that all flights, hotels, and ground transport displayed via integrated providers (e.g., Duffel, Booking.com) are booked and paid directly with those vendors. Jogeave merely synchronizes itineraries and passes confirmations.

5. User Responsibilities & Compliance

Work Authorization

Workers must self-certify valid work authorizations (e.g., visas, permits) for the location of the project. Determining compliance with local labor and immigration laws is the sole responsibility of the Worker and Hirer. Jogeave disclaims liability for entry denials or work permit violations.

Tax Compliance

Users are responsible for their own tax obligations:

  • US Workers: Must provide a W-9 before receiving payouts. 1099-NEC forms will be issued for earnings over $600.
  • International Workers: Must provide a W-8BEN and are responsible for reporting income in their local jurisdiction.

Equipment & Customs

While Jogeave provides documentation assistance for ATA Carnets and customs manifests, the final responsibility for customs compliance, accurate declarations, and import duties rests with the importer (Hirer or Worker). Jogeave is not a licensed customs broker.

6. Insurance & Liability

  • Workers' Compensation: This is the Hirer’s legal responsibility where required by law. Jogeave does not provide workers' compensation coverage.
  • Limitation of Liability: Jogeave is not liable for the quality, safety, or legality of the services provided by Workers, nor for the ability of Hirers to pay. We are not a party to the service agreement between users.
  • Dispute Resolution: Users agree to resolve disputes through binding arbitration (JAMS or AAA), preceded by a mandatory mediation period.
